
Partner Visa
A spouse visa is for an Australian citizen, permanent resident, or eligible New Zealand citizen to sponsor their spouse to settle in Australia and become a permanent resident (PR) based on a genuine marriage/de facto relationship.
Australian onshore partner visa (820/801)
1. The 820/801 visa requires the applicant to apply within Australia. Obtaining permanent residency involves two stages: first, submitting an 820 temporary residency visa application; and then, after two years of holding the 820 visa, applying for the 801 permanent residency visa.
2. Applicants must submit their applications within Australia. After submitting the visa application, a bridging visa will be granted, allowing the applicant to legally work and live in Australia while awaiting visa approval.
3. After submitting the 820 visa application, the applicant can obtain a Bridging Visa A and freely enter and exit Australia with the application for Bridging Visa B.

4. Children of spouses under the 820 visa category can still be included in the visa application as secondary applicants, provided that it can be proven that the adult children's basic living needs depend on the applicant's financial support (such as tuition fees, food, accommodation, etc.).
Australian offshore spouse visa (309/100)
1. The 309/100 type partner visa also has two stages. The first stage, the 309 temporary residence visa, is applied for and successfully granted from outside Australia, allowing the applicant to work and live in Australia. After two years from submitting the 309 visa application, the applicant can apply to change it to an 801 (onshore application) / or 100 (offshore application) permanent residence visa.
2. The 309 partner visa requires the applicant to submit the visa application from outside Australia and wait for the visa to be granted from outside Australia before entering Australia.
3. If an applicant for a 309 partner visa is pending and wishes to enter Australia, they will need to apply for another visa, such as a tourist visa or a student visa. Once the 309 visa is approved, the applicant can freely enter and leave Australia. However, it is important to maintain the cohabitation relationship and close ties between the applicant and their sponsor when traveling to and from Australia.
4. For spouses applying for a 309 visa from overseas, the secondary applicant will be subject to an age limit of 23. Not only at the time the visa application is submitted, but also at the time the 309 temporary visa is granted, the children of the secondary applicant must be under 23 years of age.
